Welcome to Article 30. These Terms of Service ("Terms") govern your use of our website www.article30.com (the "Site") and our services. By accessing or using the Site and our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the Site or our services.

1. Services

Article 30 provides nationwide, remote Examinations Under Oath (EUOs), Remote Statements, and Interviews for insurance carriers and other clients. Our remote services include:

  • Scheduling and conducting remote EUOs.

  • Providing remote notary services for sworn testimonies.

  • Remotely recorded statements

  • Remote interviews, including employment interviews and interviews for content creation purposes (podcasts, blogs, etc.)

Each EUO Service includes:

  • Shared Calendar: Using our Clio Manage software, we provide a single destination for all calendar dates and documents pertaining to your scheduled EUO. This will ensure you can access the EUO file at any time.

  • Notary Services: We provide a notary for your appointment to ensure that the testimony is sworn and legally binding.

  • Thorough File Review: Before the EUO, our team conducts a detailed review of the file to ensure we are fully prepared and informed.

  • Notifying the Insured: We handle all communication with the insured, sending notices via mail, email, phone, and other available methods to ensure they are properly informed of the upcoming EUO. Every EUO service includes two attempts to contact the insured.

  • Preparation for the EUO: Our team prepares meticulously for the examination to ensure a smooth and efficient process.

  • Digital EUO via Video Platform: We conduct fully digital EUOs via Zoom or another video platform of the insurance carrier's choice, providing flexibility and convenience.

  • Comprehensive Post-EUO Report: After the EUO, we compile and deliver a full report detailing the examination and findings. Please note, that while we provide an in-depth and professional EUO service, we do not offer legal advice or coverage opinions post-EUO. Should you require a coverage opinion, we will coordinate with our partner law office, Parker, PLLC Attorneys at Law, to ensure you receive the necessary legal expertise.

Our Recorded Statement Service Includes:

  • Professional Interviewers: One of our experienced paralegals will conduct the recorded statements to ensure all necessary information is thoroughly and accurately captured.

  • Remote Convenience: All recorded statements are conducted remotely via secure digital platforms, providing convenience and flexibility for both the insured and the insurance carrier.

  • Comprehensive Documentation: We provide a complete transcript and recording of the statement, ensuring that all details are meticulously documented and easily accessible for review.

  • Timely Reporting: Our efficient process ensures that you receive the recorded statement and accompanying documentation promptly, aiding in the swift resolution of your claims.

  • Security and confidentiality: We prioritize the confidentiality and security of all information shared with us, adhering to strict privacy standards to protect sensitive data.

Service Policies:

  • Complex EUOs: We consider a Complex EUO an EUO involving more than three examinees. We accommodate complex EUOs on a case-by-case basis. Contact us to learn more.

  • Additional EUOs per claim/loss: Each additional examinee and EUO taken per claim/loss will incur an extra charge of $1000 for our Core EUO Service and $1750 for our Advanced Service.

  • Rush EUOs: A Rush EUO is an EUO that is needed within five business days of the initial referral and incurs an additional charge of $150 per EUO per claim/loss.

  • No-Show Policy: If the insured/examinee is a no-show for a scheduled and confirmed service, a no-show fee of $725 will still apply for our Core EUO and $1225 for our Advance EUO Service. For Recorded Statements, the no-show fee is $150. We can attempt to reschedule the service if the carrier so chooses. Rescheduling a service after a no-show will result in regular fees being applied.

  • Notice Fees: Additional attempts to contact the examinee are called "notice fees." Every booked service includes two attempts to contact the insured/examinee. After two attempts to contact the insured/examinee with no response, the carrier may request that we make additional attempts, resulting in a $100 notice fee.

  • Multiple, unrelated EUOs per examinee: For special cases where a carrier needs more than one EUO taken from one person but for unrelated claims, individual EUO charges will be applied.

  • Rescheduling and Cancellations: We allow up to two cancellations/re-schedule requests per service. We equate the third cancellation/rescheduling request as an attempt to collect an EUO/statement. At this time, we will let the carrier know that we have been unable to collect the EUO/statement due to multiple cancellations/rescheduling requests and it will be at the carrier’s discretion whether or not to deny the claim, or they may choose to request that we make additional attempts to contact. This will result in “notice fees” which are explained above.

2. Booking and Payment

Booking Process

Clients can book EUO, Statement, or Interview services through our Site by selecting the desired service and providing the necessary information. Confirmation of appointments will be sent via email after reviewing the booking request. This confirmation is what confirms the date of the service.

At the time of booking, the client must make the Article 30 team aware of any extra examines (you can submit up to two on your original book form, and add up to one more examinee at the time of formal booking). They must also decide whether they need investigative services or a court reporter at an extra charge.

Payment Terms

Payment for services is required as per the terms agreed upon during the booking process.

3. Client Responsibilities

Clients are responsible for:

  • Providing accurate and complete information required for the EUO.

  • Ensuring timely payment for services rendered. Payment is due within 30 days of EUO delivery. Past-due bills will be charged 6% interest, monthly until payment is rendered.

  • Cooperating with Article 30 to facilitate the remote EUO process.

4. Confidentiality and Data Privacy

Confidentiality:

Article 30 is committed to upholding the confidentiality of all information provided by clients and insured parties. We strictly adhere to professional standards and legal obligations regarding the protection of sensitive information. We will not disclose or share any information without explicit written consent, except as required by applicable laws or regulations.

  • We prioritize the security and privacy of your personal information. Our approach includes:

  • Encryption: All sensitive data transmitted through our website, including personal information and communications, is encrypted using industry-standard SSL (Secure Sockets Layer) technology.

  • Secure Storage: Your data is stored securely on our servers, which are protected by advanced firewall and intrusion detection systems.

  • Access Control: Access to your data is restricted to authorized personnel only, ensuring that only individuals with a legitimate need-to-know can access sensitive information.

  • Clickjack Protection: We implement clickjack protection measures to safeguard against clickjacking attacks, which can maliciously manipulate user interactions with our website.

  • Regular Audits and Updates: We conduct regular security audits and updates to our systems and protocols to mitigate risks and maintain the integrity of your data.

  • Compliance: Our practices align with relevant data protection regulations and standards to ensure your data is handled with the utmost care and in accordance with legal requirements.

5. Use of the Site

Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms.

You agree not to use the Site in any way that could damage, disable, overburden, or impair the Site or interfere with any other party's use of the Site.

Prohibited Activities

Engaging in any unauthorized use of the Site, including but not limited to attempting to gain unauthorized access to the Site or other accounts, computer systems, or networks connected to the Site, through hacking, password mining, or any other means.

6. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Article 30 or its content suppliers and is protected by international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our express written permission.

7. Limitation of Liability

To the fullest extent permitted by law, Article 30 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the Site or our services.

  • Any unauthorized access to or use of our servers and/or any personal information stored therein.

  • Any interruption or cessation of transmission to or from our services.

8. Indemnification

You agree to indemnify, defend, and hold harmless Article 30, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorneys' fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations. You also agree to hold us harmless and understand that it is up to you to decide how to use or rely upon the EUO, statement, or interview. We are not responsible for bad faith lawsuits that may occur as a result of the carrier's decision.

9. Termination

We may terminate or suspend access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the services will immediately cease.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Texas in which Article 30 is headquartered, without regard to its conflict of law provisions.

11. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the effective date. Your continued use of the Site and services following the posting of any changes constitutes acceptance of those changes.

12. Agreement to Terms

By using our services, you agree to these Terms of Service. If you do not agree, please do not use our services.

13. Out Clause

Either party may terminate this agreement with 30 days' written notice. Termination does not relieve you of any obligations to pay fees or costs incurred prior to the termination date.
